Introduction

These Terms and Conditions (“Terms”) govern your use of the Swipe Pay (or affiliates) services and any associated products (collectively, the “Services”). By accessing or using the Services, you agree to comply with and be bound by these Terms.

Definitions

For the purposes of these Terms:- “Merchant” refers to any individual or entity using the Services to process payments.- “Swipe Pay” refers to Swipe Pay and its affiliates providing the Services.- “Services” include payment processing, merchant account services, and any other related services offered by Swipe Pay.

Merchant Responsibilities

Merchants must:- Ensure that all information provided to Swipe Pay is accurate and complete.- Comply with all applicable laws and regulations.- Maintain the security of their account credentials.- Use the Services solely for legitimate transactions.

Fees and Payments

Swipe Pay will charge fees for the Services as specified in the Merchant Agreement. Fees may include, but are not limited to, transaction fees, monthly service fees, and chargeback fees. Merchants authorize Swipe Pay to deduct such fees from their merchant account.

Security and Data Protection

Swipe Pay implements industry-standard security measures to protect Merchant data. Merchants are responsible for safeguarding their login credentials and ensuring the security of their systems.

Limitation of Liability

Swipe Pay will not be liable for any indirect, incidental, or consequential damages arising from the use of the Services. Swipe Pay’s total liability shall not exceed the amount of fees paid by the Merchant in the three months preceding the incident giving rise to the claim.

Termination

Either party may terminate the Merchant Agreement with 30 days’ written notice. Swipe Pay may terminate the Agreement immediately if the Merchant breaches any terms or engages in fraudulent activities.

Governing Law

These Terms are governed by and construed in accordance with the laws of the state in which Swipe Pay is headquartered, without regard to its conflict of law principles.

Amendments

Swipe Pay reserves the right to amend these Terms at any time. Amendments will be effective upon notification to the Merchant or posting on the Swipe Pay website.

Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure of Swipe Pay to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
